TERMS OF SERVICE

Lunarshells Internet Services -- (Revised: November 6th, 2006)


Attention current and prospective customers! -- Please read the following Terms of Service to ensure you follow our guidelines and protect your account from suspension or removal. There are several programs that we do NOT allow on our machines. If any of the programs listed below are stored on your account, you will be suspended without notice. Please read the entire Terms of Service to learn all the rules and regulations of LunarShells. It is your responsibility to read and understand these rules for the mutual benefit of LunarShells and its users. One or more violations may result in the removal of your account without refund. LunarShells reserves the right to make changes and adjustments to the Terms of Service without warning at any time.

# PsyBNC Terms of Service -- (Added April 18th, 2005)


This addition was made for all the LunarShells customers to understand the rules that we have for using PsyBNCs. As most of you know, we purchased the BoomShells Internet Services back in late 2004. After the purchase was complete, we went through most of the customer accounts and ended up finding over 10 logins on each of the two servers we decided to keep (Atomic and Fire) that were abusing PsyBNC usage. These logins had multiple PsyBNCs running and/or a MASS amount of users on the PsyBNCs. This is what has lead the 2 servers to be akilled from IRCNET (Luckly Pluto has received no AKILL on IRCNET and we are still able to host our IRCNET customers). This also caused numerous K-Lines all over the other networks, including but not limited to the following: EFNET, DALNET, and UnderNet. We have been able to remove most K-Lines off EFNET since the network has some great understanding IRCopers and a couple K-Lines on Undernet, however, DALNET and IRCNET IRCops are very hard to get a hold of, and we are sure they have busy lives, so we cannot blame them for not being able to get this worked out yet. This abuse, however, has made us change our TOS on PsyBNC usage right after we acquired BoomShells.

We decided to make this site so our customers are well aware of our PsyBNC policies, which consist of:

1. Not being able to run more than 1 PsyBNC background per login, which means if you want more PsyBNCs you will have to get multiple logins/shells, which we have worked out with a few of our customers.

2. Not being able to have more than 2 Max Users, including the admin, so 1 Admin + 1 Users. (Unless you own the BNC Account 3.)

Please note that any abuse on the terms above will result in suspension and possible removal of account. This change was made to allow our new acquired servers from getting on anymore K-Lines or from allowing our current server to get on any. If you have any questions, feel free to contact us on our support channel #LunarShells in EFNET.

# Abuse/Suspension/Removal


The following constitute examples of situations where the account owner will be suspended and/or removed and no refunds will be awarded:

K-Lines: If an ircop from any network contacts us stating that you have caused a k-line to any of our ips or are abusing their server, your account will be removed without notice and no refund will be awarded.

DDOS Attacks/Hacking: If you are caught trying to hack or cause DDOS Attacks from our servers, this includes you causing any DDOS attacks on our servers. Your account will be removed without notice and no refund will be awarded.

Nick Jupes/Channel Takeovers: We do not tolerate any type of nick juping (stealing someone else’s nick to cause damage to the owner of the nick) or takeover of channels. This type of behavior creates needless DDOS attacks and hatred towards the company. Anyone caught will have their accounts removed without notice and no refund will be awarded.

** Be aware, that based on the severity of the abuse above, your information will be forwarded to the authorities and you may be held under investigation. **

Unjustifiable CPU or memory usage
quota abuse
bandwidth abuse

If our administrative team finds that the account holder is abusing their bandwidth they will be removed/suspended. Users will be charged for excessive use of bandwidth, $5.00 per MB. Users may not run more “Background Processes” than they purchased, use an IP address for services that the client did not purchase, will not packet (denial of service attacks), or do any activity that may cause harm or damage to LunarShells’ servers. These activities are based upon the opinion of LunarShells’ Administrative Team, NOT the client. The owners account will be removed and or suspended if any infractions occur, without refund. **NO Denial of Service programs may be stored on your account. If we find any software of this matter on your account, it will result in permanent removal without refund. The owners account will NOT be reopened.**

Clients are NOT permitted to use Webcam servers, Shoutcasts, Ventrilo, Energy Mechs(E-MEchs), Game servers, unauthorized daemons, XDCC file serving, or any process that hogs CPU and/or Memory on our servers. Hacking, Password Cracking, Port Sniffing or any unlawful actions will result in immediate removal. The proper authorities will be contacted to rectify the situation.

Users will be removed and or suspended for violations mentioned above. Accounts are removed/suspended without client consent. If you follow our guidelines, there will be no warrant for the account owners’ suspension/removal. NO refunds are given after the account has been active for over twenty-four hours. There are no refunds upon the removal of an account. We will not prorate a refund for an account that is suspended.

# Storage of Illegal Software


Do NOT store illegal files on your shell account. These files include mp3’s, movies, games, pornographic photographs, storage of credit card numbers, software that is not shareware (copyrighted), and credentials that do not belong to the shell account holder. The internet provides a healthy amount of illegal documentation and software; none of the latter are permitted to be stored on our machines.

# Account Sharing


The owner of the shell account is the ONLY person that is permitted to use the account. Please ascertain permission from the LunarShells staff if you want help setting up your shell/bnc account. You are responsible for your account; no one else. Anything done to harm LunarShells’ server stability will cause your account to be removed immediately without notice. If any damage is done to our machines, that client will be held responsible for the cost of repairs.

# Billing


The account owner MUST notify LunarShells administrators regarding the cancellation of his/her account. Please contact us ONE week before your next billing cycle. You may contact us on Internet Relay Chat (IRC), EFnet, #LunarShells OR you may e-mail us: you will find several e-mail addresses, to contact us, under the ‘Support’ link situated on our homepage: http://www.LunarShells.com. An account holder is not entitled to a refund when their monthly, quarterly, bi-annual, or annual payment is due. You may request a cancellation for the next month to ensure you will not get billed. If the client fails to make their billing deadline, all files stored on the account will become property of LunarShells. Clients will NOT have the opportunity to log into their account and retrieve any programs or files they may have stored as their account has been suspended; NO exceptions.

# Billing Payments


A reminder notice is sent ONCE (about one week prior to the billing deadline) to the account owners e-mail address provided on their order form. The payment must be made prior to their due date. The account will be suspended until payments are made; no exceptions. It is the clients’ responsibility to remember when their billing date is (even if the e-mail has not been received).

LunarShells accepts the following forms of payment: Credit Cards, Verified Paypal Accounts, Western Union, Money Orders, and Personal/Business checks. We also accept cash, however, we recommend you spend an extra 50 cents and get a Money Order. If you do plan on sending cash, make sure you get shipping tracking to make sure that we receive it. We will not be held responsible for lost or mishandled mail.

# Account Activation


LunarShells must receive a full payment from our clients before any account is activated. Prices are subject to change without notification, however, all clients will receive notification of these changes roughly 2 weeks prior to the change. Those who paid in advance for more than one month will not encounter any price changes, if there are any.

# Refund Policy


Lunarshells will not give any refunds once the user logs into any of the shell account(s) the user has purchased. The IP address the user uses to log into his or her account(s) will be logged and kept for proof that the user has logged in if needed for any disputes that the user tries to make for a refund and will be used as proof that the user used his or her account(s).

# Disclaimer


LunarShells is not responsible for lost data stored on LunarShells’ servers, nor is LunarShells responsible for any damages that a client/business may suffer. LunarShells makes no warranties of any kind, expressed or implied for service we provide. LunarShells will provide access to our servers to the best of our ability. There may be service outages, which LunarShells has no control over. However, if there are instances where an outage is longer than 48 hours, the LunarShells Administrative Team will add the number of days the outage occurred to the billing cycle (If services are not available for more than two days in a row, we will add two days to your billing cycle). We can not guarantee the stability of this service as our machines are not in our physical presence.
